When employees are posted, numerous reporting and readiness obligations must be observed, including the posting report to the central coordination office of the Federal Ministry of Finance for the control of illegal employment.

Changes to posting in 2021
The work performed in Austria must be based on a cross-border service contract between the posting company and the client. There are changes regarding long-term posting from 12 or 18 months.

Difference between German and Austrian GmbH
A GmbH pays taxes in both Germany and Austria. The differences in the area of corporate income tax, a GmbH in Austria, pays 25% corporate income tax, but no trade tax. Profits that a GmbH in Austria receives from a subsidiary are completely tax free.

An Austrian GmbH always pays a certain amount of tax, with the amount of tax depending on when the GmbH is formed. In the first five years, a GmbH in Austria pays €125.00 per quarter or €500.00 per year in fixed taxes. This is followed by a five-year period in which taxes of €250.00 per quarter are due.
