Permanent Establishment Issue:
When renting premises, you must ensure that it is not classified as a permanent establishment by the tax authorities in the country.

Establishment of a dependent branch:
In order to establish a dependent branch office, a large number of documents must be submitted. It is essential that these are all translated into the local language. In addition, a manager must be appointed for the branch in France and registered in the French commercial register.

Incorporation of a company:
As long as a company under French law is not registered in the commercial register, it lacks legal capacity. For legal transactions resulting from this, the acting persons are personally and unlimitedly liable to the contracting party.

From a tax and accounting point of view, registered branches as well as subsidiaries must have separate circuits. Accounting& balance sheets must be kept and prepared according to French regulations (Plan Comptable général) and are subject to French taxes.

Employee secondment:
You must designate a representative in France vis-à-vis the authorities, who will also serve as a contact person. French labor law contains more than 500 valid collective agreements that must be observed. In the event of inspections by the French authorities (inspections dutravail), all required documents must be carried by the employee when performing his or her duties, or alternatively be available and immediately accessible at the company's previously designated representative.

Labor Law:
French labor law is much more complex than German labor law. If you intend to hire an employee for the French market, it is imperative that you are familiar with it and comply with all the framework conditions.
