Employee secondment
Employee postings must be registered with the Polish State Labor Inspectorate and an inspection of the workplace must be agreed to before the employee starts work.

Obligation to register
After 30 days, the posted employee must register with the relevant municipal authority, and if the posting lasts longer than 90 days, the employee must register with the relevant administrative district. For this purpose, some documents, such as proof of rental space (rental contract, etc.) must be submitted.

Contact person in the country
Companies must appoint a contact person in the country for the duration of the assignment. This person is the contact person for authorities and must be available for inspections.

Custody obligation
The archiving period is 24 months after the end of the assignment and concerns all relevant documents on and about the assignment.

Penalties
Violations of the requirements of the Posted Workers Act are punishable by more than the equivalent of 7000.00 euros.

Establishment
The Polish spzoo is equivalent to the German GmbH and for both entities there is limited liability of the shareholders with the respective contribution. However, there are some significant and some minor differences between the two. This concerns the form of the articles of association, the establishment, but also the external representation. The registration and filing of Spzoo in the Polish Commercial Register is different, but also in terms of liability of the board of directors (management) for debts of Spzoo, both entities differ from each other.
